3.1 By accessing and using the Company’s services, the Consumer agrees to these Terms and Conditions.
3.2 If the Consumer does not agree to these terms, they must refrain from using the services provided by the Company.

4. Services Offered

4.1 The Company offers the following financial services:

4.2 The services are subject to approval, based on the Company's discretion and compliance with local laws.

5. Eligibility

5.1 Consumers must be at least 18 years old and legally capable of entering into binding contracts to use the Company’s services.
5.2 Consumers must provide all required documents, including but not limited to:

  • A valid South African ID
  • Latest payslip
  • 3 months' bank statement

5.3 The Company reserves the right to verify the Consumer’s identity and creditworthiness as per the Financial Intelligence Centre Act (FICA) requirements.

6. Application Process

6.1 To access any of the services, the Consumer must complete an application form either online or in person.
6.2 The Company may request additional documentation for eligibility assessment.
6.3 All personal information provided will be handled in accordance with relevant South African laws.

7. Fees and Charges

7.1 All applicable fees and charges will be clearly outlined in the service agreement provided at the time of the loan or service application.
7.2 Zakhe Finance reserves the right to amend its fee structure at any time, and any changes will be communicated to the Consumer in writing.

8. Payment Terms

8.1 Payments are due on the specified due dates as outlined in the service agreement.
8.2 Payments can be made via automatic debit orders to ensure convenience for both parties.
8.3 Late payments will incur additional fees, and repeated delays could result in legal action.

9. Consumer Rights

9.1 Consumers have the right to request detailed information about their account at any time, including but not limited to fees charged and loan terms.
9.2 If a Consumer objects to any terms of the loan or agreement, they must do so in writing. The Company will review such objections but reserves the right to enforce the terms.

10. Limitation of Liability

10.1 The Company shall not be held liable for any indirect, incidental, or consequential damages arising from the use of its services.
10.2 Zakhe Finance does not guarantee the approval of any loan application, and all approvals are subject to credit checks, Consumer eligibility, and other discretionary factors.

11. Compliance with Laws

11.1 The Company is fully committed to complying with all applicable South African laws and regulations, including but not limited to:

  • The Protection of Personal Information Act (POPI)
  • The Financial Intelligence Centre Act (FICA)
  • The National Credit Act (NCA)

11.2 The Company reserves the right to disclose personal information as required by law or to fulfill legal obligations.

12. Amendments to Terms

12.1 Zakhe Finance reserves the right to amend these Terms and Conditions at any time.
12.2 Changes will be posted on the Website, and they become effective immediately upon posting.

13. Governing Law

13.1 These Terms and Conditions are governed by and construed in accordance with the laws of South Africa.
